These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Telemetry Wealth LLC ("Telemetry Wealth," "we," "our," or "us") governing your access to and use of the Telemetry Wealth personal finance platform, including any associated websites, mobile applications, and services (collectively, the "Service").
By creating an account, accessing, or using the Service, you represent that you are at least 18 years of age, have read and understand these Terms, and agree to be bound by them. If you do not agree to these Terms, do not use the Service.

The Service is intended for personal, household financial management purposes. It is not intended to constitute investment advice, tax advice, or financial planning services. We are not a registered investment advisor, broker-dealer, or financial planner.
To use the Service, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You agree to notify us immediately at support@telemetrywealth.com if you become aware of any unauthorized access to or use of your account. We are not liable for any loss resulting from unauthorized use of your account credentials.
Each user may maintain only one account. You may not create multiple accounts or share your account credentials with others.
The Service is offered on subscription plans that differ in the features and usage limits available. The plans currently offered, the features included in each, and their prices are described at the point of purchase and may change as the Service develops. Certain features, including the Avi AI assistant, are available only on paid plans.
Premium subscriptions are billed on a monthly or annual basis, as selected at the time of purchase. All payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis at the then-current subscription price until you cancel.
We may offer free trial periods for the premium tier at our discretion. At the end of a free trial period, your subscription will automatically convert to a paid subscription unless you cancel before the trial period ends.
We may change the subscription price at any time. We will provide at least 30 days' advance notice of any price increase. Continued use of the Service after the effective date of a price change constitutes your acceptance of the new price.
You may cancel your subscription at any time by contacting us at support@telemetrywealth.com. Cancellation takes effect at the end of the current billing period. We do not provide refunds for unused portions of a subscription period, except where required by law.
If a payment fails, we will attempt to retry the payment per our payment processor's retry schedule. If payment remains unsuccessful after the retry period, we may suspend or downgrade your access to paid features. We will provide notice before doing so.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
You retain ownership of all financial data you provide to or connect through the Service. We do not claim any ownership rights in your financial data.
By using the Service, you grant us a limited, non-exclusive license to access, process, and use your financial data solely for the purpose of providing and improving the Service. We do not use your individual financial data to train AI models or for any purpose other than providing the Service to you.
We rely on third-party data providers (including SimpleFIN) to retrieve your financial account information. We do not guarantee the accuracy, completeness, or timeliness of data retrieved from third-party sources. You should verify important financial information with your financial institutions directly.
You may download an export of your data at any time from your account settings, under Profile, or request one by contacting us at support@telemetrywealth.com.
The Service, including all software, algorithms, user interfaces, designs, text, graphics, and other content, is owned by Telemetry Wealth LLC and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes in accordance with these Terms.
You may not reproduce, modify, distribute, sell, or create derivative works from any portion of the Service without our prior written consent.
If you provide us with feedback, suggestions, or ideas about the Service, you grant us a perpetual, irrevocable, royalty-free license to use such feedback without restriction or compensation to you.
The Service integrates with third-party services including financial data providers (SimpleFIN), payment processors (Stripe), and cloud infrastructure providers. Your use of these integrations is subject to the third parties' terms of service and privacy policies. We are not responsible for the availability, accuracy, or security practices of third-party services.
When you connect a financial account, you authorize the applicable data provider to access your financial account information on your behalf and to share it with us for the purpose of providing the Service.
THE SERVICE IS PROVIDED FOR INFORMATIONAL AND ORGANIZATIONAL PURPOSES ONLY. NOTHING IN THE SERVICE CONSTITUTES INVESTMENT ADVICE, TAX ADVICE, LEGAL ADVICE, OR ANY OTHER PROFESSIONAL FINANCIAL ADVICE. YOU SHOULD CONSULT A QUALIFIED FINANCIAL ADVISOR, TAX PROFESSIONAL, OR ATTORNEY BEFORE MAKING ANY FINANCIAL DECISION.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TELEMETRY WEALTH LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100).
You agree to indemnify, defend, and hold harmless Telemetry Wealth LLC and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) your infringement of any third-party rights.
You may terminate your account at any time by contacting us at support@telemetrywealth.com.
We may suspend or terminate your account and access to the Service at any time, with or without notice, if we determine that you have violated these Terms, if we are required to do so by law, or for any other legitimate business reason.
Upon termination, your right to use the Service immediately ceases. We will delete your account and associated data in accordance with our Privacy Policy. Provisions of these Terms that by their nature should survive termination shall survive, including Sections 7, 9, 10, 11, 13, and 14.
These Terms are governed by the laws of the State of Illinois without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Cook County, Illinois, and you hereby consent to personal jurisdiction in such courts.
BEFORE FILING ANY CLAIM IN COURT, YOU AGREE TO PROVIDE US WITH WRITTEN NOTICE OF YOUR DISPUTE AND TO ATTEMPT TO RESOLVE THE DISPUTE THROUGH GOOD-FAITH NEGOTIATION FOR AT LEAST 30 DAYS.
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website and, where appropriate, by sending you an email notification. The "Effective Date" at the top of these Terms indicates when they were last updated. Your continued use of the Service after the effective date of any update constitutes your acceptance of the revised Terms.
(a) Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Telemetry Wealth with respect to the Service.
(b) Severability. If any provision of these Terms is found invalid or unenforceable, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in effect.
(c) No Waiver. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
(d) Assignment. You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
